RillaWitt in this policy refers to RillaWitt International Limited, its subsidiaries and other partnerships, corporations, undertakings and entities that are authorized to practice using the name “RillaWitt”. Please see ‘Data Controllers’ below for information on persons that control and process personal data at RillaWitt.

The personal information we collect may include your basic information (e.g., your name, your organization, your title, etc.), contact information, financial information, identification and background information, personal information provided to us by or on behalf of our clients or generated by us in the course of providing services to them, technical information (e.g., information from your visits to our website or applications or in relation to materials and communications we send to you electronically), and any other information that you may provide to us.

Means of Obtaining Personal Information

Your personal information may be collected via the following means:

  • Through your use of our digital platforms (e.g., website)

  • When you contact or request information from us

  • During our business acceptance processes

  • When you engage us for tax or other services or as a result of your relationship with our staff or clients

  • When you provide to us during our interactions

We may also collect and/or receive information about you from other sources (e.g., publicly available sources to keep the contact details we already hold for you accurate and up to date).

Communications

We may use your personal information to understand whether you read the emails and other materials that we send to you (e.g., tax news and insights), click on the links to the information that we include in them and whether, how, and when you visit our website after you click on that link. Relationship management tools may also be used, where permitted by applicable local law, to assess the strength of the relationship between RillaWitt and our clients or potential clients based on the frequency of email contact. This information is used to assess, analyze and improve the services we provide.

If you receive marketing communications from us and no longer wish to do so, you may inform us at any time by sending an email to markets@rillawitt.com.

Events, Meetings and Seminars

In relation to attendance at our offices or at an event, meeting or seminar organized by RillaWitt or its business partners, we may collect, process and/or use specific categories of personal information about your dietary or access requirements in order to cater for your needs and/or to meet any other legal or regulatory obligations that we may have. We may share your information with IT, other service providers and business partners involved in organizing or hosting the relevant meeting, event or seminar.

Tax and other services

During and in connection with the services we provide, we may collect, create, hold and/or use personal information (e.g., identification and background information) during the below processes:

  • Administration and marketing (e.g., anti-money laundering, conflict, reputational, financial checks, etc.) 

  • Business acceptance

  • Finance

  • Performance of our work for the clients

Website

Certain facilities on our website invite you to provide us with personal information (e.g., applications in the ‘Careers’ section, email queries, etc.). We only use that information for the apparent purposes of these facilities at the point you provide your personal information.

Basis of Use of Personal Information

Duration of Personal Information Retention

Our global data retention policy governs our personal information retainment. The policy categorizes the information held by RillaWitt and specifies the appropriate retention period for each category of data. The periods are determined based on the following:

  • Good practice

  • Limitation periods for taking legal actions

  • Requirements of applicable data protection laws and the purpose for which the information is collected and used, taking into account the minimum retention period for meeting legal and regulatory requirements

  • RillaWitt business purposes

Sharing of Personal Information

As an international network of member firms, any information that you provide to us may be shared with and processed by entities in the RillaWitt network. With respect to third parties, we may share your personal information with them in accordance with the contractual arrangements we have in place with them, including:

  • Our IT service providers

  • Our professional advisors and auditors

  • Suppliers to whom we outsource certain support services (e.g., word processing, translation, photocopying, document review, etc.)

  • Third parties engaged in the course of the services we provide to clients and with their prior consent, such as corporate service providers, local counsel and technology service providers like data room and case management services

  • Third parties involved in hosting or organizing events, meetings or seminars

  • Where required, or for the reasons set out in this policy, personal information may also be shared with regulatory authorities, courts, tribunals, government agencies and law enforcement agencies. While it may be unlikely, we could be required to disclose your information to comply with legal or regulatory requirements. In such cases, we will use reasonable endeavors to notify you before we do this unless we are legally restricted from doing so

In cases of re-organizing or transferring all or part of our business, we may transfer your information to new RillaWitt entities or to third parties through which the business of RillaWitt will be carried out.

For social media sites used by RillaWitt, such as Facebook. If you use these services, you should review their privacy policies for more information on how they handle your personal information. 

We do not sell, rent or otherwise make personal information commercially available to any third parties without obtaining your prior permission.

Means of Protecting Personal Information

A variety of technical and organizational measures are used to help protect your personal information from unauthorized access, use, disclosure, alteration or destruction consistent with applicable data protection laws.

Your Rights regarding Your Personal Information

There are regulations and other applicable data protection laws that provide certain rights for data subjects. You are entitled to request details of the information we hold about you and how we process it. You may also have a right in accordance with applicable data protection laws to have it rectified or deleted, to restrict our processing of that information, to stop unauthorized transfers of your personal information to a third party and, in some circumstances, to have personal information relating to you transferred to another organization. You may also have the right to lodge a complaint in relation to RillaWitt’s processing of your personal information with a local supervisory authority.

On the occasion that you object to the processing of your personal information, or if you have provided your consent to processing but later choose to withdraw it, we will respect that choice in accordance with our legal obligations. Your objection (or withdrawal of any previously given consent) could mean that we are unable to perform the actions necessary to achieve the purposes set out under ‘How we use your personal information’ or that you may not be able to make use of the services or products offered by us. Please note that, however, even after you have chosen to withdraw your consent we may be able to continue to process your personal information to the extent required or otherwise permitted by law, in particular in connection with exercising and defending our legal rights or meeting our legal and regulatory obligations.

Data Controllers

RillaWitt as a network of member firms that provides tax and other services via a number of entities, each of which is a separate legal entity. The majority of RillaWitt’s main IT systems are located in Hong Kong and controlled by RillaWitt. Depending on the location where tax or other services are rendered, another undertaking or entity in the RillaWitt network may be the data controller in respect of your personal data.
